UWC has conducted conference calls with CMS to address policy issues related to WCMSAs. CMS indicated an interest in addressing an option to permit direct payment of Medicare Set-aside amounts directly to CMS instead of having amounts maintained by individuals under the workers’ compensation settlement. They also noted that they had an interest in discussing the impact of workers’ compensation limitations on settlement amounts approved by CMS and the method used to estimate the amount of prescription drug costs in future medical. Although these issues have been acknowledged, administrative policy for review of WCMSAs and Section 111 reporting has not as yet made adjustments.
As the cost of prescription drug prices for Medicare are reduced through Trump administration initiatives, such reductions should be reflected in estimates of future medical for WCMSAs.
We plan to raise these issues through this new opportunity to comment for webinars, and encourage UWC members tor respond to the latest request from CMS.
